Terms of service

1. What Ivy Beside is, and isn’t

1.1 Ivy Beside informs, guides and organises. I introduce you to a specialist in plastic, reconstructive and aesthetic surgery in Turkey (“the surgeon”) and the hospital where he operates (“the clinic”), and support you organisationally before, during and after your stay.

1.2 Ivy Beside is not a medical provider. I am not a doctor. I make no diagnosis, give no medical advice and make no statement about suitability, technique, materials or outcome. That is solely the surgeon’s role after personal examination and consent.

1.3 The treatment contract is made solely between you and the clinic or surgeon. Ivy Beside is not a party to it and is not liable for medical services.

2. Formation of contract

2.1 Your enquiry does not create a contract. The first call is without obligation.

2.2 The guidance contract with Ivy Beside is formed when, after receiving the clinic’s quote and after the reflection period (clause 5), you confirm in writing (email, message) that you wish to use the guidance, and I confirm.

2.3 The contract language is English. These terms are sent to you in writing before the contract is formed.

3. My services

• First call and clarification of your non-medical questions
• Forwarding your details and photos to the surgeon through an encrypted channel, with your separate consent
• Feeding back the surgeon’s assessment and discussing it on a video call, with the surgeon if you wish
• Explaining the clinic’s quote line by line
• Date and flight suggestions; arranging hotel and transfers with the clinic
• Availability during your stay; on-site support is provided by the English-speaking clinic team
• Access to the companion app with checklist, appointments, contacts and documents
• Availability for organisational questions for six months after surgery

3.2 Not part of my service: medical treatment, consent, medical aftercare, booking flights in your name, arranging insurance, or any assurance about outcome, healing or absence of complications.

4. Fees and payments

4.1 You pay Ivy Beside nothing. My service is remunerated by the clinic, with which I have a contract. This fee is included in the clinic’s price and does not increase your costs. I disclose that I receive it.

4.2 Deposit and balance for treatment are paid solely to the clinic on its terms. I take no money for treatment and pass none on. The clinic’s terms on amount, due dates, cancellation and refunds are provided to you in writing before the deposit and are not part of these terms.

4.3 Flights, meals outside the hotel, insurance and all costs of treatment at home are yours.

5. Reflection period

5.1 Between receiving the clinic’s quote and your decision there is a reflection period of at least seven days. I accept no commitment during this time and apply no pressure.

5.2 You may withdraw at any stage before the deposit without giving reasons and at no cost towards Ivy Beside.

6. Cancellation right

6.1 If you are a consumer and the guidance contract was concluded at a distance, you have a statutory right to cancel within fourteen days of the contract being formed. A clear statement to the address or email in the legal notice suffices. A model form is at the end of these terms.

6.2 If you expressly ask me to begin the guidance before the cancellation period ends, your right to cancel remains; since you pay Ivy Beside nothing, no charge arises on cancellation.

6.3 Cancelling towards Ivy Beside does not affect your contract with the clinic. Its terms govern withdrawal and refund of the deposit.

7. Your part

• Truthful and complete information about health, medication, smoking, prior conditions and previous surgery, to me and to the surgeon
• Timely provision of documents the surgeon requests (blood tests, ECG etc.)
• Following the surgeon’s instructions before, during and after surgery, in particular stopping smoking, compression, clearance to fly
• Booking the return flight only after clearance or on a flexible fare
• Taking out travel insurance that covers you; complications insurance is recommended
• Keeping contact details current and being reachable during the stay and aftercare

7.2 If the surgeon concludes at the on-site pre-op assessment that the procedure cannot go ahead, or not as planned, that is a medical decision I cannot influence. What then happens to deposit, hotel and transfers is governed by the clinic’s terms; I help you with the process.

8. Health data, photos, real courses

8.1 You send photos and results only through the encrypted channel I provide, with your separate explicit consent under UK GDPR. Not via WhatsApp, Instagram or email attachment.

8.2 Real courses of other patients are shown only at your explicit request in a personal conversation, for information. They are not advertising, not a promise of results, and may not be saved, copied or shared.

8.3 Your own images are never shown to anyone without your separate, revocable written consent.

8.4 Everything else is in the privacy notice.

9. Liability

9.1 Ivy Beside is not liable for medical services, their quality, safety, course or outcome. The clinic or surgeon is liable under the law governing the treatment contract.

9.2 For my own services I am liable without limit for death or personal injury caused by negligence and for fraud; otherwise my liability is limited to foreseeable loss arising from breach of these terms. Nothing here limits your statutory rights as a consumer.

9.3 Airlines, hotels, transfer providers and insurers are liable for their own services.

10. Law and jurisdiction

10.1 These terms are governed by the law of England and Wales. If you live in Scotland, Northern Ireland or Ireland, you keep the protection of mandatory consumer law where you live and may bring proceedings there.

10.2 The treatment contract with the clinic is governed by the law and jurisdiction agreed there, usually Turkish law. I point this out expressly before the deposit.

11. General

If any provision is invalid, the rest of the contract remains in force. Changes to these terms apply to contracts formed after publication.
